1. Agreement
These Terms of Service ("Terms") are an agreement between you and instApped ("instApped," "we," "us" or "our"). They govern your use of instapped.com, the app factory at create.instapped.com, our build service and any related tools (together, the "Service"). By using the Service you agree to these Terms, our Privacy Policy and our Acceptable Use Policy. If you use the Service for an organization, you agree on its behalf and confirm you have authority to do so.
2. Eligibility
You must be old enough to form a binding contract where you live, and at least 16 years old, to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian who agrees to these Terms.
3. The service
instApped lets you package a website, HTML file or ZIP project as an Android app. The Service can save projects in your browser, preview your project, run pre-build checks, submit build jobs and return Android build files such as APK and AAB files.
We may add, change or remove features at any time. Builds depend on third-party infrastructure and on the content you provide, so we don't guarantee that every build will succeed, finish within a particular time or meet a particular app store's requirements.
4. Your content
"Your content" means the files, website addresses, app names, icons, settings and other material you provide. You keep all rights to your content.
You give us a limited, worldwide, non-exclusive, royalty-free license to host, copy, process, transform and transmit your content only as needed to operate the Service: to validate it, build your app, deliver build files to you, troubleshoot and keep the Service secure. This license ends when your content is no longer held by the Service, except for copies kept in build records or backups as described in our Privacy Policy.
You confirm that you own your content or have every permission needed to use it this way, and that it doesn't infringe anyone's rights or break any law.
5. Ownership of generated apps
As between you and us, you own the apps built from your content. The Android project template, build scripts and other code we supply as part of a generated app are licensed to you on a non-exclusive, perpetual, worldwide, royalty-free basis to use, modify and distribute as part of your app. Open-source components included in an app remain subject to their own licenses.
6. Your responsibilities
- Test each build on real devices before you distribute it.
- Make sure your app and its content follow applicable law and the policies of any store where you publish it.
- Provide your own privacy policy and disclosures for your app, covering any data your website or app collects.
- Keep your own copies of your source files and build outputs. Browser storage can be cleared, and we don't promise to keep build files indefinitely.
- Use the Service only as allowed by our Acceptable Use Policy.
7. App stores
You publish your app under your own developer account. instApped is not a party to your agreement with Google Play or any other store, and we don't control whether a store accepts, rejects or removes your app. Store fees, reviews, ratings and policies are between you and the store. Android and Google Play are trademarks of Google LLC, and instApped is not affiliated with or endorsed by Google.
8. Signing keys and credentials
Never put passwords, private keys, keystores or other secrets in your project files or website source. Where a signing feature is offered, credentials must be supplied only through the secure method that feature provides. You are responsible for keeping your own signing keys safe. If you lose the key for an app you have published, you may be unable to update that app.
9. Fees
We may introduce paid plans or features. If we do, we'll show the price and terms before you're charged, and you won't be charged for a paid feature you haven't agreed to buy.
10. Our intellectual property
The Service, including its software, design, text and the instApped name and logo, belongs to instApped and its licensors and is protected by law. Except for the rights in section 5, these Terms don't give you any right to use our name, logo or branding. Don't copy, resell or reverse-engineer the Service except where the law allows you to.
If you send us feedback or suggestions, we may use them without any obligation to you.
11. Suspension and termination
You can stop using the Service at any time. We may suspend or end your access, refuse a build or remove content if we reasonably believe you have broken these Terms or the Acceptable Use Policy, if required by law, or to protect the Service, our users or others. Where it's reasonable and lawful, we'll tell you why. Sections 4 to 7 and 10 to 17 continue after termination.
12. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement and that the Service will be uninterrupted, secure or error-free. We don't warrant that a generated app will work on every device or be accepted by any app store. Some places don't allow these disclaimers, so some may not apply to you.
13. Limitation of liability
To the fullest extent the law allows, instApped will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Service. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or USD 50.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud or for death or personal injury caused by negligence.
14. Indemnity
To the extent the law allows, you agree to defend and indemnify instApped against third-party claims, and related losses and reasonable costs, arising from your content, your apps or your breach of these Terms.
15. Changes
We may update these Terms. We'll change the effective date above and, for material changes, give reasonable notice on this site or in the app factory before they take effect. If you keep using the Service after the changes take effect, the updated Terms apply. If you don't agree, stop using the Service.
16. Governing law
These Terms are governed by the laws of the place where instApped is established, without regard to conflict-of-law rules. Courts in that place have jurisdiction over disputes, unless the consumer protection law where you live gives you the right to bring a claim in your local courts or under your local law.
17. General
These Terms, together with the policies they refer to, are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver of it. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of the Service.
